Darkroom Terms of Use

These terms are an agreement between you and Wesley Roberts ("we", "us") about your use of the Darkroom app. By using Darkroom you agree to them and to our Privacy Policy.
Using Darkroom
- You must be at least 13 years old. If you're under 18, you need a parent or guardian's permission.
- Keep your sign-in secure. You're responsible for what happens in your account.
- One person per account.
How vaults work
- A vault collects shots from its members. Shots can't be seen by anyone until the vault develops on the date its host set. The host can only move that date later.
- After it develops, members can view and download shots as the vault's settings allow. Original files are deleted 7 days after the vault develops; slideshow shots and the highlight video are kept while the vault exists.
- Hosts choose the vault's settings, who can join, and the content filter level, and can remove shots after the reveal. Hosts of public events are responsible for running them appropriately.
Your content
- You own the photos and videos you take.
- To run Darkroom, you give us a non-exclusive, worldwide, royalty-free licence to store, process, check, copy and display your shots to the members of the vaults you add them to, and to make slideshows and highlight videos from them. This licence ends when your shots are deleted, except for copies other members have already downloaded.
- By adding a shot to a vault, you confirm you have the right to share it, and that the people in it would be OK with it being shared with that vault.
What's not allowed
Don't use Darkroom to share or do anything that:
- is illegal, including child sexual abuse material (which we report to authorities);
- shows someone nude or in a sexual situation without their consent;
- harasses, bullies, threatens or humiliates anyone;
- shows graphic violence intended to shock;
- infringes someone else's copyright, privacy or other rights;
- is spam, or tries to break, overload or get around the app's security or limits.
We may remove content, close vaults, or suspend or delete accounts that break these rules, and report illegal content to the authorities.
Reports
If you see something that breaks these rules, report it in the app (open the shot → ⋯). We, and the vault's host, may review and remove it.
Ending your account
You can delete your account at any time in the app. We may suspend or close accounts that break these terms, or if we stop offering Darkroom (we'll give reasonable notice where we can so you can download your shots).
The service
- Darkroom is provided "as is". We work hard to keep it running and your shots safe, but we can't promise it will always be available or error-free, or that shots will never be lost. Download anything you want to keep within the 7-day window.
- Nothing in these terms excludes rights you have under the Australian Consumer Law or other laws that can't be excluded. To the extent the law allows, our liability is limited to resupplying the service, and we're not liable for indirect or consequential loss.
Changes
We may update these terms. We'll show the new effective date above and tell you in the app about significant changes. If you keep using Darkroom after that, the new terms apply.
Law
These terms are governed by the laws of New South Wales, Australia.
